A Vietnamese Criminal Record Certificate (also known as a Police Check, Police Clearance, Criminal History Check, Ly Lich Tu Phap) is a certificate issued by the Vietnamese National Centre for Criminal Record (NCCR) or a Provincial Judicial Department to prove whether or not an individual has a previous criminal conviction, or is banned from holding certain posts, establishing or managing enterprises or cooperatives where enterprises or cooperatives have been declared bankrupt by a Vietnamese court. The foreigner who reside in Vietnam, no matter how long they actual reside in Vietnam, have the right to request an Authority Judical to issue a Criminal Record Certificate.

Extra copies can be ordered at the time you make your application or up to three months after the date the certificate was printed. The cost is US $30 for each copy. The information disclosed on a Police Certificate is subject to the ‘Step Down Model’ as set out in the Retention Guidelines for Nominal Records on the Police National Computer.

All certificates contain a number of security features to prevent fraud and unauthorized production or copying. Police Certificates are only issued in hard copy and never sent electronically. If you want someone other than you to deal with your application on your behalf, you must provide written consent. See Section 8 of the application form. When your check is submitted to the Judicial Authority, your name, id, date of birth and gender are checked against a central database of names to find potential matches with people who have Justice History Information. If you have a common name (for example John Nguyen or Hoang Nguyen), or your name is similar to someone that has Justice History Information, your application will be manually reviewed by the staff for further investigation. The relevant judicial agency will then manually process your check to determine if your details are a match or not.
